Please read these Terms and Conditions (“Terms”) carefully before using the Hiking Diary mobile application (the “App”) operated by SaguaroBytes LLC (“us”, “we”, or “our”).

By downloading or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not use the App.

1. Hiking Involves Risk (The Important Stuff)

We built Hiking Diary to be a helpful companion for your adventures, but it is not a substitute for common sense, preparation, or traditional navigation tools.

  • Hike at Your Own Risk: Hiking, mountaineering, and outdoor activities involve inherent risks, including injury, getting lost, or encountering dangerous weather/wildlife. By using this App, you acknowledge that you are voluntarily participating in these activities and assume all risk of injury or loss.
  • Data Accuracy: GPS, elevation, and weather data provided by mobile devices can be inaccurate due to signal loss, hardware limitations, or environmental factors. Do not rely solely on Hiking Diary for critical navigation, especially in remote or dangerous areas. Always carry a backup (like a paper map and compass) and let someone know where you are going.

2. Privacy

Your privacy is our priority. Our use of your personal information is governed by our Privacy Policy, which explains that we do not store your data on external servers. By using the App, you agree to the collection and use of information as described in that policy.

3. Intellectual Property

  • Our Stuff: The Hiking Diary app itself, including its code, design, graphics, and original content, is the property of SaguaroBytes LLC and is protected by copyright laws. You may not copy, modify, or distribute the App’s code or assets without our permission.
  • Your Stuff: You retain full ownership of the data you create using the App (your hiking logs, photos, and notes). We claim no ownership over your personal hiking history.

4. Prohibited Uses

You agree not to use the App to:

  • Engage in any unlawful activity.
  • Attempt to reverse engineer or decompile the App.
  • Harass or harm others.

5. Disclaimer of Warranties (“As Is”)

The App is provided on an “AS IS” and “AS AVAILABLE” basis. SaguaroBytes LLC makes no warranties, expressed or implied, that the App will be error-free, that GPS data will be perfectly accurate, or that the App will meet your specific requirements.

6. Limitation of Liability

To the maximum extent permitted by law, SaguaroBytes LLC shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to:

  • Personal injury or physical harm sustained while using the App.
  • Loss of data (e.g., if a hike log fails to save).
  • Device failure or battery drain.

In simple terms: We do our best to build a great app, but we are not responsible if your phone battery dies on the trail or if the GPS isn’t perfectly accurate.

7. Changes to Terms

We reserve the right to modify these Terms at any time. We will try to provide notice of any major changes. By continuing to use the App after those revisions become effective, you agree to be bound by the revised terms.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Texas, United States of America, without regard to its conflict of law provisions.
